Health-Addict and/or its clients may, at its sole discretion, terminate or suspend the access to the Services and/or products or any portion thereof of any user for any reason.

Eligibility

You must be at least 18 years old to be eligible to use these Services and/or products. However, if you are at least 13 years old but not yet 18, you may use the Services and/or products if, and only if, you have your parents' or guardians' prior permission. No one under age 13 may use the Services and/or products under any circumstances. By clicking the "SUBSCRIBE" button you are representing that you are at least 18, or that you are at least 13 years old and have your parents permission to register for the Services and/or products found on this website.

User Costs

There may be some costs associated with the use of Health-Addict and its Clients services. For example, your pager or cellular phone service provider may charge you to receive Wireless Text Messages. Neither Health-Addict its partners, or its clients, will be held responsible for any charges related to the use of the Services and/or products under any circumstances. All such charges are the sole responsibility of the individual who receives these under all circumstances.

Pricing Policy

Health-Addict may change pricing of all services and/or products without notice. All new users of services and/or products will be subject to the new prices as soon as they have been updated on www.health-addict.com. Those users who have already purchased services and/or products will not be subjected to price increases until the expiry of their current purchased service and/or products, after which they will be subject to the new pricing policy.

Warranty & Disclaimer

HEALTH-ADDICT PROVIDES THE SERVICES "AS IS" WITH NO WARRANTIES OF ANY KIND. HEALTH-ADDICT EXPRESSLY DISCLAIMS ANY WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE SECURE, UNINTERRUPTED OR FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS.

REFUNDS OF SUBSCRIPTION SERVICES ARE ONLY OFFERED ON THOSE PUBLISHED NEWSLETTERS THAT HAVE NOT BEEN RECEIVED BY THE USER AND HAVE BEEN PAID FOR IN ADVANCE. FOR CLARIFICATION ONLY THE MONETARY DIFFERENCE BETWEEN WHAT HAS BEEN ALREADY RECEIVED AND THAT WHICH HAS BEEN PAID IN ADVANCE WILL BE REFUNDED. ALL NEWSLETTERS THAT HAVE BEEN RECEIVED BY THE USER WILL NOT BE REFUNDED.

Limitation of Liability

UNDER NO CIRCUMSTANCES WILL HEALTH-ADDICT OR ITS EMPLOYEES, OFFICERS, OR DIRECTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICES WHETHER OR NOT HEALTH-ADDICT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If you are dissatisfied with the Services and/or products or any content on any of Health-Addict or its client's website properties, or with these Terms and Conditions, your sole and exclusive remedy is to discontinue using the Services and/or products. You acknowledge, by your use of the Services and/or products, that your use of the Services and/or products is at your sole risk.

Indemnity

You agree to indemnify, defend and hold harmless Health-Addict its partners, clients, employees, officers and directors, from and against any and all claims, liabilities, penalties, settlements, judgments, fees (including reasonable attorneys' fees) arising from (i) any content that you or anyone using your account may submit, post or transmit to the web site; (ii) your use of the Services and/or products; (iii) your violation of the terms of these Terms and Conditions; and (iv) any violation or failure by you to comply with all laws and regulations in connection with the Services and/or products.

Opt-out/Unsubscribe

Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications e-mail us at feedback@health-addict.com.  Users may wish to include the phrase ‘REMOVE MY SUBSCRIPTION' in the subject heading. All automatic subscription payments via Paypal will also be deactivated.

Users of our site are always notified when their information is being collected by any outside parties. We do this so our users can make an informed choice as to whether or not they should proceed with services that require an outside party. Under no circumstances will Health-Addict share or divulge the details of their clients to any third party without prior explicit permission from the user.

Assignment

You may not assign any of your rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without the prior written consent of Health-Addict or its client's. Any such purported assignment or delegation by you without the appropriate prior written consent of Health-Addict or its client's will be null and void and of no force or effect.
